Foreign Exchange Services User Terms

 

1. HashKey MENA FZE ("HMF") provides foreign exchange services ("Services") merely as an ancillary service to facilitate virtual asset trading activities conducted on the platform (the “Permitted Purpose”). The Services are facilitated through arrangements with third-party licensed bank(s) ("Banking Partners"). You hereby undertake to use the Services solely for the Permitted Purpose.

 

2. These Terms shall supplement and shall be read together with the Investor Business Terms and all other agreements entered into between you and HMF. To the extent of any inconsistency between these Terms and the Investor Business Terms, these Terms shall prevail in respect of the Services.

 

3. The exchange rate quoted for the Services is provided by our Banking Partners and is for indicative purposes only. The final, executable rate may include an HMF's service fee of no more than 0.3%. The actual exchange rate at which your transaction is executed shall be final and binding.

 

4. The Services are provided on an "as is" and "as available" basis. The availability, timing, and execution of the Services are contingent upon the operational availability of our Banking Partners. HMF does not guarantee that access to the Services will be uninterrupted, timely, or error-free. The Services may be subject to delays, interruptions, or disruptions due to various factors, including but not limited to, banking cut-off times, target currency holidays, scheduled system maintenance, or unforeseen technical or market-related events.

 

5. HMF reserves the right, in its sole discretion, to suspend, restrict, or terminate your access to the Services, or to reject any of your transaction requests, at any time and without prior notice. Restrictions imposed may include, but are not limited to, transaction limits (on value or frequency), requiring enhanced due diligence, and other risk control measures. Such action may be taken for any reason, including but not limited to:

(a) any breach of the Permitted Purpose or these Terms;

(b) if you provide any false, misleading, or incomplete information;

(c) if you have insufficient funds to complete a transaction;

(d) if we detect any activity we reasonably deem to be fraudulent, abusive, manipulative, or intended to gain an unfair advantage; or

(e) to comply with applicable laws, regulations, or orders from law enforcement, regulatory bodies, or the requirements and risk controls of HMF or our Banking Partners.

 

6. To the maximum extent permitted by applicable law, HMF, its affiliates, directors, officers and employees shall not be liable for any direct, indirect, incidental, special, or consequential losses, damages, or costs incurred by you arising from or in connection with your use of the Services. This includes, without limitation, any losses arising from:

(a) any interruption, delay, or disruption to the Services;

(b) exchange rate fluctuations before or after your transaction is executed; or

(c) any action, inaction, or imposition of restrictions by our Banking Partners.

 

7. HMF reserves the right to amend, modify, or revise these Terms at any time and in its sole discretion. Any such amendments will be effective immediately upon posting the revised version on our official website. It is your responsibility to review the website periodically for the latest version of these Terms. Your continued use of the Services following any amendments will constitute your acceptance of, and agreement to be bound by, such revised Terms.​​​
